Terms of use

Medley is a shared event photo and video album service, published by Max Bryselbout (see the legal notice). These terms set out the rules between Medley, album organisers and their guests. They are written to be read: each section says what it does.

1. Acceptance

Creating an organiser account constitutes acceptance of these terms and of the privacy policy. For guests, who take part without an account, using the service (uploading, reacting, commenting, downloading) constitutes acceptance of the rules that concern them, in particular sections 4 to 6. The terms are permanently reachable from the footer of the site and from the album.

2. The service

Medley lets an organiser create an album for an event, and lets the people holding that album's link or QR code upload photos and videos to it, view them, react to them, comment on them and download the album. The service is currently provided free of charge, in full (photos and videos, original quality), during the test phase governed by section 10. Medley evolves continuously: features may be added, changed or removed, without degrading your ability to retrieve your content.

3. Your account

The organiser is responsible for keeping their credentials confidential and for the actions taken from their account. Tell us without delay in case of unauthorised use. An account is personal: it is not lent and not resold.

4. The album link: an access, not a safe

Access to an album rests on its link (and its QR code): anyone holding that link can view, upload and download the album's content. That is what lets guests take part without an account. Consequently:

  • the organiser chooses who they pass the link to, and takes responsibility for that distribution (a sign in a private venue is not a public post on a social network);
  • each participant undertakes not to redistribute the link beyond the circle of the event;
  • Medley cannot be held liable for access to an album by a person to whom the link was passed, directly or indirectly, by the organiser or a participant.

5. Your content, your warranties

Uploaded photos and videos remain the property of their authors. By uploading content, you grant the publisher a limited, non-exclusive and royalty-free licence, for the sole technical purposes of providing the service: storage, thumbnail generation, display and delivery to the people who have access to the album. No commercial or advertising exploitation, and no model training.

By uploading content, you warrant:

  • that you hold the necessary rights in that content (you are its author, or you have its author's permission);
  • that distributing it to the people who have access to the album does not infringe third-party rights, in particular the image rights of the people appearing in it;
  • that it falls into none of the prohibited categories in section 6.

You indemnify the publisher against any third-party claim based on content you have uploaded: if a third party takes action against them on account of your content, you will bear the direct consequences of that claim to the extent it results from a breach of your warranties above.

6. Prohibited content and moderation

Content contrary to the law or to third-party rights is prohibited: infringing content, invasions of privacy or of image rights without permission, hateful or violent content, child sexual abuse material or manifestly unlawful content, as well as any use of the service for spam, mass distribution or interference with its operation.

For content uploaded by users, the publisher acts as a host within the meaning of article 6 of the French LCEN: it has no general obligation to monitor, and promptly removes any manifestly unlawful content duly reported to it (max.bryselbout@gmail.com, stating the album). In addition, the organiser can remove any content from their album, and each participant can delete their own uploads.

7. What Medley promises, and what it does not

Medley is provided with care and diligence (an obligation of means): we do everything we can for the service to be available, fast and reliable, including during your events. We cannot, however, guarantee uninterrupted availability (maintenance, incident, force majeure).

Medley is not a guaranteed archiving service: it is a shared album. The retention period is set out in section 10 and in the privacy policy; at the end of it an album may be removed, never without the organiser having been informed beforehand. Even so, keep your original files and download the complete album after the event. Should the service stop, or a feature affecting your content close, organisers will be warned with a reasonable period to retrieve everything.

8. Liability

To the extent permitted by law, the publisher's liability in respect of the service is limited to direct and foreseeable damage caused by a breach attributable to them; it extends neither to content uploaded by users (section 6), nor to the consequences of distributing the album link (section 4), nor to indirect losses. Nothing here excludes or limits their liability in the event of wilful misconduct or gross negligence, of personal injury, or in any other case where the law does not permit it. Consumers' statutory rights remain in all circumstances.

9. Suspension and termination

In the event of a serious or repeated breach (unlawful content, abuse of the service, interference with its operation), the publisher may suspend or close access to an album or an account, after notice save in an emergency. The organiser can delete their account and their albums at any time; deleting an album entails deleting its content, as described in the privacy policy.

10. Test phase: free of charge, and retention

Medley is in its test phase. The service is provided free of charge, in full, and no payment is requested or accepted: no purchase, no subscription, and no collection of banking data on any basis whatsoever.

Retention. Albums created during this phase are kept at least until December 31, 2026. The originals of your photos and videos are kept with the album: nothing is reduced to web quality during the test phase. Download the complete album after your event all the same: a platform is not a backup.

And afterwards. A paid offer may be introduced later, at the planned price of 49 € per event. That price is indicative and may change before it comes into service. The offer will only apply to albums created after it: no feature already used for a past event will become paid retroactively, nor to the detriment of retrieving your content.

11. Changes

These terms may evolve with the service. The date in force appears at the top of the page; in the event of a substantial change, organisers will be informed by email or in the application before it takes effect. Using the service after that date constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by French law, the publisher being established in France. Any dispute will be brought before the competent courts; if you are a consumer, you have the benefit of the rules of jurisdiction and protection provided by law, including those of your country of residence, and may use any amicable route before taking action.
